As SledheadX says: most folks rent a cabin at the Twin Grove Campgrounds INFO HERE. It's about twenty minutes from the park.

You can also stay at the Comfort Inn in Pine Grove INFO HERE. It's about fifteen minutes from the park.

I understand bro, sorry for your troubles. Family first.

Just a heads up, signing up doesn't cost and does not commit you to attending the event. It just helps us prepare if you are able to.

Also, buying a cool event shirt or awesome hoodie does not commit you to attend the event. You'd just cover the shipping and I'd get it to you after the event.
Just sayin...

The waiver covers the "agents, officers and associates of NEXterra." "Officers" are defined in the ByLaws, "agents" has a fairly straightforward legal definition, but "associates" is ambiguous and is not clearly defined in the waiver or elsewhere that I can find. That's the reason I haven't considered attending, but if you're willing to provide a waiver with a concrete definition of accept a waiver with that term lined out I'd potentially be in.

I'm also the person that actually reads terms of use and privacy policies. But yeah, if they care enough to want signed waivers, why shouldn't I exercise the same diligence before signing a waiver? If it's "no big deal" then they shouldn't require them in the first place.

There are several other problems with their waiver, but none that are ultimately detrimental to the person signing them.

I’m sure it’s to protect those of us who volunteer to lead groups and or spot who are not agents or officers.

Honestly, it’s better you don’t come. You sound exactly like the type of person that this waver is designed for.

I’ve never filed a lawsuit in my life. What I’m saying is that a waiver should be designed to protect the organization, while not putting others at risk. This waiver is asking me to put myself and my property at risk and lose rights and protections that are unreasonable because it’s overly broad. It’s obviously some half-assed attempt to splice together a bunch of stuff found in other places online instead of something carefully crafted by an attorney and designed to protect the organization AND participants.

Just as it would be stupid for a club to hold a private event like this without a waiver, it would be stupid of me to sign that particular waiver and participate in the event. I’m looking out for myself, not looking for an angle to blame somebody else for something that’s my own fault. I’m a huge believer in people being responsible for their own actions and hate petty lawsuits. I resent your comment.

And to my point, when you say “I’m sure it’s” or “it’s probably” that’s precisely the problem. It’s not clear. If it were clear and specific, I’d have no problem signing it. But it’s written as a blanket waiver of everyone involved both in an “official” capacity like being a spotter and in a personal ‘doing whatever’ capacity. It shouldn’t be.

I’m specifically the type of person you wouldn’t have to worry about. I take responsibility for myself, and if I tell somebody to spot me, I assume the risk if they tell me to take a line and I break something. I can’t think of a single realistic scenario in which I would sue an actual club. The people I go off-roading with, I know they’re stand-up people and if one of them was acting dumb and wrecked my truck (or worse), I know they’d take responsibility for it and pay for it, and I’d do the same.

But there are scumbags out there who wouldn’t take that responsibility. There are some that would take an overly broad waiver like this (or more importantly, their insurance company would take a waiver like this) and say “ffxcores clearly waived any right to any legal claim of negligence against me” and they’d be right. Just as the club needs to protect themselves from that, any participant should also have that same protection.

All will be welcome to join but would need to sign and hand in the Rausch Membership Application/Waiver, the Rausch Parental Waiver (if applicable) and the NEXterra waiver to participate.

I’m sorry if that doesn’t work for everyone.

Eddie and SledheadX, I plan on being there and would be looking at the stock / green category. Still in the middle of changing out my shocks (stripped a nut on the left rear shackle trying to get it off) but hope to have that done this weekend. More to follow as we get closer and my ride is back on the road! ;-)
